Terms of Use

These terms are an agreement between you and QuickAppsAI ("we", "us") for your use of the Vibe Bloom app and this website (together, the "Service"). By downloading or using Vibe Bloom you agree to them. If you do not agree, please do not use the Service.

A wellness tool, not medical care

Vibe Bloom offers music, soundscapes, generated noise and tones for relaxation, sleep, focus and meditation. It is not a medical device and it does not diagnose, treat, cure or prevent any condition. Descriptions of tone traditions (such as Solfeggio frequencies) describe traditions, not proven effects. If you have concerns about your sleep or health, talk to a qualified professional.

Listen at a comfortable volume. Do not use binaural beats or other tones while driving or operating machinery, and stop if you feel discomfort. If you have epilepsy, a seizure disorder or a heart condition, ask your doctor before using rhythmic tones.

Who can use it

You must be at least 13 years old, and old enough to agree to these terms where you live. If you are under the age of majority, use Vibe Bloom with the permission of a parent or guardian.

Your account

Vibe Bloom creates an anonymous account automatically. You can connect it to Sign in with Apple or Google to keep your library across devices. You are responsible for activity under your account. You can delete your account at any time in the app's Settings; our Privacy Policy explains what happens to your data.

Our content and your license

The music, soundscapes, artwork, text and software in Vibe Bloom belong to us or our licensors and are protected by copyright and other laws. We give you a personal, non-exclusive, non-transferable, revocable license to use Vibe Bloom and listen to its content for your own non-commercial use. You may not copy, download outside the app, redistribute, broadcast, sell or publicly perform the content, use it in other works, or reverse engineer the app, except where the law allows it regardless of this restriction.

What you create

Mixes, playlists and names you create stay yours. You give us permission to store and process them to provide the Service, for example to sync your library or create a cover for a mix. Do not give mixes names that are unlawful, hateful or infringe someone else's rights.

Acceptable use

Do not misuse the Service: do not interfere with or try to gain unauthorised access to it or other people's data, do not use it to break the law, and do not use automated means to extract content.

Price and changes to the Service

Vibe Bloom is currently free and has no in-app purchases. We may add, change or remove features or content, and if we ever introduce paid features we will show the price and terms before you buy anything. We may suspend accounts that break these terms.

Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement, and we do not promise that the Service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data or profits, arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or 50 US dollars. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer.

Apple App Store terms

If you downloaded Vibe Bloom from the Apple App Store:

• These terms are between you and QuickAppsAI only, not Apple. Apple is not responsible for Vibe Bloom or its content.
• Your license is limited to using Vibe Bloom on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for Vibe Bloom.
• If Vibe Bloom fails to conform to an applicable warranty, you may notify Apple and Apple will refund any purchase price paid for it. To the extent the law allows, Apple has no other warranty obligation regarding Vibe Bloom.
• Apple is not responsible for addressing claims relating to Vibe Bloom, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• If a third party claims that Vibe Bloom or your use of it infringes their intellectual property, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must also comply with any applicable third-party terms when using Vibe Bloom.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Changes to these terms

We may update these terms. We will change the date above and, for significant changes, tell you in the app. If you keep using Vibe Bloom after a change, the updated terms apply.

Governing law

These terms are governed by the laws of the place where QuickAppsAI is established, without regard to conflict-of-law rules, except where the law of your country of residence gives you the right to rely on its mandatory consumer protections.
